1. The race will take place at the U.S. National Whitewater Center on Sunday, April 20, 2008 at approximately 4:00 p.m. local time.  All ducks will be provided by KinderMourn (the event organizer) and will remain the property of Great American Merchandising and Events (the presenter).
2. Approximately 12,000 ducks will be entered in the race.
3. In the case of inclement weather, acts of God or other circumstances, the event organizer reserves the right to postpone or reschedule the race, or determine winners by a random drawing, in its sole discretion.
4. Once the ducks are launched, participants may not interfere with any duck. 
5. A number will be attached to each duck relating to the number on an adoption certificate.  Multiple duck entries from one ticket will be assigned additional numbers for identification.  The person’s name that appears on the adoption certificate corresponding to the first ducks in the order of retrieval, will be awarded prizes. 
6. The entry portion of each adoption paper must be completely filled out and received by KinderMourn prior to the start of the race for a ticket to be eligible to win a prize. Entrants assume the risk of non-delivery of any entries.  All mailed entries not received on or before April 20, 2008 become tax-deductible donations to KinderMourn.
7. No purchase necessary to win.  KinderMourn does request a donation of $5.00 per entry to benefit KinderMourn, a charitable organization under Section 501 (c) (3) of the Internal Revenue Code.  Free entry tickets defeat the charitable fundraising purpose of the event and are not encouraged.  However, one free entry ticket per person can be obtained by presenting a handwritten request to KinderMourn at 1320 Harding Place, Charlotte, NC  28204 and submitting a self-addressed, stamped return #10 envelope for mailing of entry ticket.  Requests for free entry tickets made after 12,000 ducks have been adopted will not be honored.  All requests must be made before March 28, 2008. 
8. Winners must be 18 years of age or older and must prove eligibility.  Members of the Hope Floats Duck Race Leadership Team, KinderMourn staff and Board members are not eligible to win. 
9. Any and all taxes, tags, titles and similar fees are the sole responsibility of the winner.  Winner must provide tax identification number to KinderMourn for income-reporting purposes.
10. By entering, entrants release KinderMourn and its officers, staff, directors and other related entities from any and all liability with respect to prizes, and consents to the use of their names and likenesses without additional compensation.
11. Chances of winning depends on the total number of qualified entries.
12. This event is subject to all federal, state and local laws and regulations and is void where prohibited by law.
13. All decisions and interpretations of rules and regulations will be made by KinderMourn and its judgment is final.
14. The logo and name of the Hope Floats Duck Race is a registered trademark and no other person or entity is authorized to copy or otherwise use it without express written consent of KinderMourn and the Great American Duck Races.
15. A copy of these rules and regulations is available by sending a written request and a self addressed, stamped envelope to KinderMourn at the address listed in item 7.
16.  Prize winners will be announced at the Duck Race awards ceremony on Sunday, April 20, 2008, following the conclusion of the race.  Winners will, when necessary, also be notified by United States mail or by telephone.  If winner does not claim his/her prize from KinderMourn within 30 days after April 20, 2008, KinderMourn will select a winner through a random drawing of entry tickets.  All prizes will be awarded.
17. The Derby Duck Race/Turbo Turtle Trek is a licensed fundraising event of GAME-Great American Merchandising and Events.
